Montgomery County, Maryland Sick and Safe Leave Law

On October 1, 2016, the Earned Sick and Safe Leave Benefit Bill goes into effect for Montgomery County, Maryland.  The new law provides paid leave for all employees working in the county; employers who are physically located in Montgomery County or who are based outside of the county but have employees who work in Montgomery County.

  • An employee must earn one (1) hour for every 30 hours worked in the county up to 56 hours in year.
  • employers with five (5) or more employees must provide paid leave.
  • employers with less than five (5) employees must provide 32 hours of paid leave and 24 hours of unpaid leave.

Employees will be entitled to use the leave in a variety of circumstances, including:

  • the employee’s physical or mental illness, injury, or condition;
  • obtaining preventive medical care for herself or a covered individual;
  • providing care for a covered individual with a covered condition or whose presence in the community would endanger the public;
  • a public health emergency; and
  • certain absences that stem from domestic violence, sexual assault, or stalking

Employers who currently provide employees more than 56 hours of paid leave per year that can be used for the same circumstances contemplated by this new law do not have to provide additional paid leave. To learn more details, click on this link http://bit.ly/2curonq
