Relaxed I-9 FAQs for Employers

Federal I-9 Form Requirement Flexibility Extended Until 10/31/22

DHS (Department of Homeland Security) and ICE (U.S. Immigration and Customs Enforcement) has extended the flexibility offered to employers and workplaces operating remotely in complying with I-9 Form requirements due to COVID-19.  This new extension is effective until 10/31/22 when the original rules will again be enforced.  In the interim, employers and workplaces operating remotely have the ability to conduct a virtual review of I-9 required documents.  It had been set to expire 4/30/22.

Employers are cautioned that all documents that have been reviewed virtually must be reviewed in person within three days of the end of this temporary policy.  We recommend you keep a list of the documents that have not been reviewed in person and try to accomplish the in person review sometime before the expiration of the extension rather than waiting until the three day mandatory window for compliance.
