Oregon: Expands Oregon Family Leave Act (OFLA)

Effective 1/1/2022, during a public health emergency, employers that are covered by the Oregon Family Leave Act (OFLA) will have to grant OFLA leave to an employee who is usually not eligible, unless the employee:

  • Has worked less than 30 days for the employer, or
  • Has worked, on average, less than 25 hours per week in the 30 days before the start of their leave.

Employers are covered by OFLA if they have 25 or more employees in Oregon. When not in a public health emergency, an employee must work for the employer for 180 days and have worked at least 25 hours a week on average (with some exceptions) to qualify for OFLA.

OFLA now will also entitle an employee who leaves employment and is rehired within 180 days to have their previous hours worked credited toward their eligibility for OFLA leave.
