Updates to Paid Sick Time Under FFCRA

The U.S. Department of Labor released updated guidance regarding situations in which an employee may utilize the Paid Sick time under the Families First Coronavirus Response Act (FFCRA). The below reasons for paid sick leave (that were in the draft legislation) no longer qualify for leave under the final version of the law:

  • Employees with reduced hours, furloughed employees, or employees’ whose workplaces are closed; and
  • Employees whose workplaces are closed due to a federal, state, or local shelter-in-place or stay-at-home orders, or due to business slowdowns.

Employers should keep documentation to show that employees who received leave were actually eligible to receive the paid leave benefit. The documentation requirements will be outlined in soon-to-be-released IRS guidance.
